Is eBay Legit? Money Back Guarantee and Seller Rules (2026)

Yes, eBay is legit: it's a Nasdaq-listed company founded in 1995 with 136 million active buyers, according to its own SEC filing. The eBay Money Back Guarantee refunds you if an item doesn't arrive, is faulty or doesn't match the listing. The catch is that the protection disappears if any part of the payment happens outside eBay, and quality depends on each individual seller.

eBay is old enough that most of us have a story about it, good or bad. That history is part of why people still ask whether it's safe, especially when a deal looks a bit too sweet. I've gone through eBay's own buyer and seller protection rules, its latest results and the court records that made headlines, so you can judge it on the facts.

Who runs eBay and how big the company has grown

According to Wikipedia, eBay was founded in 1995 by Pierre Omidyar, starting life as AuctionWeb, and it's headquartered in San Jose, California. It trades on Nasdaq under the ticker EBAY, and Jamie Iannone has been chief executive since 2020.

The scale is hard to argue with. eBay's second-quarter earnings release, filed with the US Securities and Exchange Commission, reported 136 million active buyers and gross merchandise volume of 22.4 billion US dollars in that quarter. The same filing confirms eBay completed its purchase of the clothing resale app Depop in 2026, so eBay now owns one of the most popular apps for younger resellers too.

How the eBay Money Back Guarantee protects buyers

eBay's Money Back Guarantee policy says you can get your money back if an item didn't arrive, is faulty or damaged, or doesn't match the listing. For an item that never turns up, you can report it once the estimated delivery date has passed, and you have up to 30 calendar days after the estimated or actual delivery date to do so.

Here's how the process runs. You report the problem to the seller first through your order. If it isn't resolved, eBay can step in from 3 business days after your report, and up to 21 business days. eBay also says it may step in without being asked if there's no valid tracking information. For an item that never arrives, the refund covers the full cost of the item and the original shipping.

  • Open the request from your eBay order, not by email.
  • Keep every message inside eBay so there's a record.
  • Note the dates. The 30-day clock runs from the estimated or actual delivery date.

When eBay buyer protection won't help you

This is where most eBay horror stories begin. The Money Back Guarantee doesn't cover items where any part of the payment was completed outside of eBay. That includes bank transfers, cash and money orders. So a seller who offers a discount for paying another way is asking you to give up your protection.

Some categories are excluded too, including real estate, businesses for sale, digital content, services, travel tickets and motor vehicles. If you're buying anything in those areas, read the listing and the category's own rules before you commit.

eBay's Authenticity Guarantee for sneakers, watches and bags

For pricier branded items, eBay runs a separate check. Wikipedia says eBay launched its Authenticity Guarantee in 2020 for luxury sneakers and later expanded it to watches, handbags, jewelry and apparel. That's useful reassurance in the categories where fakes are most common. Look for the Authenticity Guarantee label on the listing itself, and if it isn't there, don't assume the item has been checked.

Selling on eBay: protections and fees

eBay is still one of the most straightforward ways to sell secondhand goods, from old phones to the contents of a loft. Sellers get protection too. eBay's seller protections page says that if you ship on time and upload tracking showing delivery by the estimated date, you generally won't be responsible for refunding a buyer who says the item didn't arrive. That makes tracked postage worth the small extra effort.

The trade-off is fees. Rather than repeat them here, I've set them out in my plain-English guide to how much eBay takes from each sale, which is worth reading before you price anything. Good descriptions sell faster, and the ideas in these ChatGPT prompts for product descriptions work just as well for eBay listings as for Etsy ones. Selling regularly can create tax obligations, so check with an accountant or your local tax office about your own situation.

What the courts said about eBay's cyberstalking case

eBay hasn't had a spotless record, and one case is worth knowing about. The US Attorney's Office for the District of Massachusetts says eBay agreed to pay a 3 million US dollar criminal penalty and entered a deferred prosecution agreement over a cyberstalking campaign that former employees ran against a Natick, Massachusetts couple who wrote about the company. Several former staff were sentenced individually.

That case was about the conduct of a group of employees towards journalists, not about buyers or sellers being cheated. It doesn't change how the Money Back Guarantee works for you, but it's part of the honest picture of the company.

Common eBay scams that use the company's name

Most eBay scams try to pull you out of eBay's system. Watch for sellers who ask you to pay by bank transfer or a payment app, buyers who say they've paid and send a screenshot or email as proof, and fake eBay emails asking you to confirm a sale or log in through a link. Fake "eBay" invoices for things you didn't buy are another favourite.

Check everything in the eBay app or by typing the address yourself. If a sale or payment isn't showing in your eBay account, it hasn't happened. And if you're selling to build some extra income, my roundup of side hustle ideas that work alongside a business has more ideas.

My view on whether eBay is legit

eBay is a legit, publicly listed company with one of the clearest buyer protection policies around. Your safety depends far more on how you pay than on eBay itself: stay inside eBay's checkout, keep messages in the app, and report problems within the time limits. Do that, and you're well covered as a buyer and as a seller.
