To become a sports agent who recruits student athletes, you'll need a state athlete agent licence where your state requires one. In Florida, for example, you must be at least 18, of good moral character, pass an FBI fingerprint check, have no relevant criminal conviction in the past 5 years and pay the application and licence fees before you can sign a student athlete.
A sports agent, or athlete agent in the legal wording, represents an athlete in deals with teams, brands and promoters. The glamorous part is the negotiating. The part most guides skip is that, once you approach college athletes, you're working inside a licensing law with strict contract rules. Here's how it works, using Florida's athlete agent statutes, which I read on Online Sunshine, the Florida Legislature's own site, in October 2026.
Rules differ from state to state, so treat Florida as a worked example and check the law where you'll recruit.
Who counts as an athlete agent
Section 468.452 defines an athlete agent as anyone who recruits or solicits a student athlete to sign an agent contract, or who tries to get them work or promotional deals with a professional team or promoter for financial gain. It also covers employees acting on the agent's behalf.
Two details matter. First, it's about student athletes: students who've told a college they intend to play, or who already play, college sport. Second, family members don't count. A spouse, parent, sibling, grandparent or guardian isn't an athlete agent, and nor is someone acting only for a professional team.

How to become a sports agent, step by step
- Learn the business. Florida's licence rules don't ask for a particular degree, so it's your knowledge of contracts, endorsement deals and your sport that will win clients.
- Check your state's law. Find out whether your state licenses athlete agents and what it asks for before you contact any college athlete.
- Apply for the licence. In Florida that means the application form, the fees and fingerprints for the state and FBI checks.
- Use the temporary licence if offered. Florida can issue a temporary licence while your application is pending, but it ends if the state issues a notice that it intends to deny you.
- Learn the contract rules before you sign anyone. They're strict, and a contract that breaks them can be cancelled by the athlete.
The 7-day exception
There's one narrow exception worth knowing. Section 468.453 lets an unlicensed person act as an athlete agent if the student athlete, or someone acting for them, gets in touch first, as long as you apply for a licence within 7 days of first acting as their agent. It isn't a loophole for recruiting. It only covers the case where the athlete comes to you.
The contract rules every agent has to follow
This is the section I'd learn by heart. Section 468.454 says an agent contract must be in a record signed or authenticated by both parties, and it must state:
- how much the athlete will pay you and how it's calculated, plus anything you'll receive from anyone else under the contract
- anyone not on your licence application who'll be paid because the athlete signed
- any expenses the athlete agrees to repay
- the services you'll provide
- how long the contract lasts and the date it was signed
The contract also needs a warning in bold capital letters near the athlete's signature. It tells them they may lose their eligibility to compete as a student athlete, that they and you must tell their athletic director within 72 hours, and that they can cancel within 14 days, though cancelling may not restore eligibility.
Here's the catch. If the contract doesn't follow these rules, the athlete can void it, and they don't have to pay you or return anything you gave them to sign. So a sloppy contract can cost you the client and everything you've invested in them.
The 72-hour notice
Section 468.454 also puts a deadline on you. Within 72 hours of signing, or before the athlete's next scheduled event if that comes first, you must notify the athletic director at the athlete's school in a record. You also have to give the athlete a copy of the signed contract when it's signed.

What the job is like
Much of the work is relationship building: earning an athlete's trust, then getting them the best deal with a team or brand. The licensing rules in Florida are aimed at protecting student athletes, so expect schools and families to ask hard questions about your contract.
If contracts are your strength, my guide on how to become a lawyer explains that route. If you're closer to the athletes themselves, becoming an athletic trainer is another way to work in sport.
My verdict
You don't need a specific degree to become a sports agent in Florida, but you do need a licence before you recruit student athletes, and the contract rules are tight. Learn the 14-day cancellation right and the 72-hour notice before your first meeting, because they're the details that protect both you and the athlete.
