Form 8809: Getting 30 More Days to File Information Returns

Form 8809 asks the IRS for more time to file information returns such as Forms W-2, 1099, 1095, 1098, 5498, 1042-S and 8027. For most forms the first 30-day extension is automatic and needs no reason, but Forms W-2 and 1099-NEC only get one 30-day extension, it must be requested on paper and you have to show one of the listed hardships. The form has to reach the IRS by the original due date of the returns.

Everything below comes from the IRS Form 8809 (Rev. December 2025) and the instructions printed with it, as of October 2026.

What Form 8809 does and doesn't extend

It only extends the date for filing information returns with the IRS. It doesn't extend the date for giving statements to recipients, so employees and contractors still need their copies on time unless you get a separate extension for that under Pub. 1099. It also isn't the form for a personal return (that's Form 4868) or for Form 1042 (that's Form 7004).

That's the insight most small employers miss: an approved Form 8809 can leave you on time with the IRS and still late with your workers. Plan the recipient copies first.

Automatic and nonautomatic extensions

RequestFormsReason needed?How to file
First 30 days, automaticEvery form on line 6 except W-2 and 1099-NECNoIRIS (free), the FIRE System, a fill-in form on FIRE, or paper
First 30 days, nonautomaticW-2 and 1099-NECYes, a line 7 reasonPaper only
Additional 30 daysEvery form except W-2 and 1099-NECYes, a line 7 reasonPaper only, before the first extension runs out

For Forms W-2 and 1099-NEC there's no second extension at all. A nonautomatic request has to be signed by the filer, the transmitter or someone authorized to sign a return.

The five reasons on line 7

A W-2 or 1099-NEC request, or any additional extension, needs at least one of these boxes checked:

  1. a catastrophic event in a federally declared disaster area made the filer unable to resume operations or made records unavailable
  2. fire, casualty or natural disaster affected the filer's operation
  3. death, serious illness or unavoidable absence of the person responsible for filing affected the operation
  4. the filer was in its first year of establishment
  5. the filer didn't receive data on a payee statement, such as a Schedule K-1 or Form 1042-S, in time to prepare an accurate return

When Form 8809 is due

File it as soon as you know you need it, but not before January 1 of the year the returns are due, and no later than their due date. If a due date falls on a weekend or legal holiday, use the next business day.

FormDue on paperDue if you e-file
W-2January 31January 31
1099-NECJanuary 31January 31
W-2G, 1094-C, 1095, 1097, 1098, 1099, 3921, 3922February 28March 31
1042-SMarch 15March 15
5498May 31May 31
8027Last day of FebruaryMarch 31

One Form 8809 can cover several form types, but then it's due by the earliest of their dates. The instructions' own example: asking for both Forms 1098 and 5498 on one request means filing it by February 28 (March 31 if you e-file). Use separate requests to avoid that.

If you skip it or file it late

An extension can't be granted if the request is filed after the returns' due date. Without a valid extension, a late information return can bring a late filing penalty; the instructions point to part O of Pub. 1099, the Instructions for Form 1042-S, the Instructions for Form 8027, the General Instructions for Forms W-2 and W-3 and the 1094/1095 instructions for the amounts. Once the extension is granted, file the returns as soon as they're ready rather than waiting for the last day.

Two special cases are worth knowing. A business that has terminated should follow the 'Terminating a business' section of the General Instructions for Forms W-2 and W-3 to ask for more time on its final W-2s. And if you e-file W-2s, the specifications come from the Social Security Administration, not the IRS, which you can reach on 800-772-6270.

Filling it in

  1. Line 1: the payer's or filer's name, address and a contact.
  2. Line 2: the nine-digit TIN, with no hyphens.
  3. Line 3: the method you'll use to file the returns, electronic or paper. Use a separate Form 8809 for each method.
  4. Line 4: if the request covers more than one payer, the total number, with a typed list of names and TINs attached.
  5. Line 5: tick only if you already have the automatic extension and need an additional one.
  6. Line 6: tick the form types. Don't enter the number of returns.
  7. Line 7: the reason, when one is required, then sign and date.

Paper requests go to the Internal Revenue Service Center, Ogden, UT 84201-0209. Don't send a copy of Form 8809 with the returns themselves; the one exception is a paper Form 8027, which gets a copy attached.

The verdict

For 1099s and the 1095 series, Form 8809 is a free safety net: e-file it through IRIS before the deadline and you've got 30 days with no questions asked. For Form W-2 and 1099-NEC, treat January 31 as fixed, because the extension is paper-only, needs a hardship and still leaves the recipient copies due. If you're filing Form 1095-C or Form 1099-MISC, note the later e-file date in the table.

Frequently asked questions

What is Form 8809 used for?

It's the request for an initial or additional extension of time to file information returns such as Forms W-2, 1099, 1095, 1098, 5498, 1042-S and 8027 with the IRS.

Is the Form 8809 extension automatic?

The first 30-day extension is automatic for every listed form except Forms W-2 and 1099-NEC, which need a reason on line 7 and a paper request.

Does Form 8809 extend the deadline to give W-2s to employees?

No. It only extends the date for filing with the IRS, not the date for furnishing statements to recipients.

Can I e-file Form 8809?

Yes for automatic requests, through IRIS or the FIRE System. Requests for Forms W-2 and 1099-NEC and any additional extension must be on paper.

How long is a Form 8809 extension?

30 days from the original due date. Most forms can get one additional 30 days on paper; Forms W-2 and 1099-NEC can't.
