Form 1042-S is the IRS information return a US withholding agent uses to report US-source income paid to a foreign person, such as royalties or fees, and any US tax it withheld. If you're a non-US creator or freelancer, it's the US payer's record of what it paid you and kept back, and it has to reach you by 15 March of the following year.
Think of it as the foreign person's version of a 1099. You don't file it yourself, but it's the document that proves any US tax withheld from you, so it matters when you claim a credit or refund.
Who sends Form 1042-S
The IRS instructions say every withholding agent must file Form 1042-S to report amounts paid during the previous calendar year that fall within its reporting rules. That's usually the platform, publisher, agency or company that paid you and collected your W-8BEN or W-8BEN-E. Individuals who are withholding agents have some exceptions, but businesses generally don't.
The payer also files Form 1042, its annual withholding tax return, alongside the 1042-S forms.
The deadline
Forms 1042-S must be filed with the IRS and furnished to the recipient by 15 March of the following calendar year, moving to the next business day if the 15th falls on a weekend or holiday. So 2026 payments should be reported to you by 15 March 2027.
A payer can ask for one 30-day extension to furnish recipient copies using Form 15397, and an automatic 30-day extension to file with the IRS using Form 8809. If yours arrives in April, that may be why.
What the main boxes mean
| Box | What it tells you |
|---|---|
| Box 1, income code | The type of income, for example code 12 for other royalties such as copyright, software, broadcasting and endorsement payments, or code 17 for independent personal services |
| Box 2, gross income | The total amount paid to you before any withholding |
| Boxes 3 and 4 | Whether chapter 3 or chapter 4 applies, with exemption codes in boxes 3a and 4a |
| Boxes 7a to 11 | Federal tax withheld, including box 7a, which must be completed in all cases even if no tax was deposited |
| Boxes 12 and 13 | The withholding agent's details and yours, including your country code, foreign TIN and LOB code |
| Boxes 16a to 16e | The payer's name, TIN, GIIN and status code |
For 2026, the IRS says a chapter 3 exemption code is now required in every case where the tax withheld is less than 30%. So if your treaty claim worked and less was withheld, there should be a code in box 3a explaining why.
The insight creators miss: services versus royalties
The income code changes how your payment is treated. Code 17, independent personal services, covers payments for services a foreign person performs in the United States, while code 12 covers royalties, including copyright and endorsement payments. Two creators can both be paid by US companies and get very different results depending on which code applies, so if the code on your form doesn't match what you were paid for, ask the payer why before you file anything.
Check it matches
The IRS tells withholding agents that the copies sent to recipients must match the copy filed with the IRS, and warns that the IRS may disallow claims for refund or credit of tax withheld if the form attached to the claim differs from the one on file. If something looks wrong, ask the payer for an amended form, which has its own amended checkbox and amendment number.
What to do when you receive one
- Check your name, country, foreign TIN and the income code.
- Check gross income against your own records.
- Note the tax withheld in box 7a and the exemption code in box 3a or 4a.
- If more was withheld than you expected, check the W-8BEN or W-8BEN-E you gave the payer was complete and hadn't expired.
- Keep Copies B, C and D with your tax records. You'll need them if you claim a refund or credit of tax withheld.
A change on the payer side for 2026
The IRS is retiring its old FIRE e-filing system. Its new Information Returns Intake System (IRIS) became available on 1 January 2026 and must be used to e-file 2026 Forms 1042-S, due 15 March 2027. Payers who leave it late may be the ones sending forms out after the deadline, so ask early if you need yours.

My verdict
A 1042-S is good news, not a problem: it's your proof of what the US paid you and what it kept. Check the income code and the withholding against your W-8 form, ask for an amended form if anything's off, and keep your copies with your tax records. Don't try to file it; that's the payer's job. And if it hasn't arrived by the end of March, ask the payer directly.
Frequently asked questions
What is Form 1042-S used for?
It reports US-source income paid to a foreign person and any tax withheld, filed by the US withholding agent with the IRS and sent to the recipient.
When should I receive my Form 1042-S?
By 15 March of the year after the payment, unless the payer gets an extension to furnish recipient copies.
Do I need to file Form 1042-S?
No. The withholding agent files it. You keep your copies and use them when you claim a credit or refund of tax withheld.
What does income code 12 mean on Form 1042-S?
Other royalties, for example copyright, software, broadcasting and endorsement payments.
Why was tax withheld on my 1042-S?
Check whether the payer held a valid, unexpired W-8 form claiming a lower treaty rate. Box 3a or 4a shows the exemption code it used.
Is Form 1042-S the same as a 1099?
No. Form 1042-S is the return for US-source income paid to foreign persons, with the tax withheld. US payees get 1099 forms instead.
What if my Form 1042-S is wrong?
Ask the payer for an amended form. The IRS may disallow a refund claim if your copy differs from the one it has on file.
