Florida doesn't have one general state business license, because the Local Business Tax Act leaves it to counties and cities. What most businesses need instead is a local business tax receipt from their county, their city, or both, which runs from October 1 to September 30. Regulated trades also need their state licence before the local receipt is issued.
So when people search for a Florida business license, the answer is usually a local business tax receipt. It comes from the Local Business Tax Act, chapter 205 of the Florida Statutes, which I read in October 2026 for this guide.
Who issues what in Florida
| What you need | Who issues it | When |
|---|---|---|
| County local business tax receipt | The county tax collector, where the county levies the tax | Sold from July 1, due by September 30 each year |
| City local business tax receipt | The city, where the city levies the tax | Same yearly cycle |
| State professional licence or registration | The state agency that regulates your trade, such as the Department of Business and Professional Regulation | Before the local receipt is issued |
Counties and cities both have the power to levy a business tax for the privilege of engaging in or managing a business, profession or occupation in their area. A city can levy it on businesses with a permanent location or branch office there. That's why a business inside city limits can owe both.
The yearly calendar
Section 205.053 sets one cycle for the whole state. Receipts go on sale from July 1, they're due on or before September 30, and they expire on September 30 the following year. If September 30 falls on a weekend or holiday, the deadline moves to the next working day. A receipt is never valid for more than one year.
How counties and cities set the amount
Chapter 205 doesn't set one figure for the whole state. Before a county or city adopts or changes its business tax, it must give at least 14 days' public notice in a local newspaper, listing the proposed classifications and rates. The tax must be based on reasonable classifications and be uniform within each class. That's why a hairdresser, a consultant and a restaurant in the same county can pay different amounts, and why the same trade can pay different amounts in two counties.
If you open part way through the year, ask about a partial receipt. Section 205.053 lets the local ordinance provide for partial-year receipts, so you may not pay the full year's tax for a business that starts in spring.
Penalties for late or missing receipts
| Situation | Penalty under section 205.053 |
|---|---|
| Renewal paid in October | 10% of the tax |
| Each later month unpaid | A further 5% a month |
| Cap on late renewal penalties | 25% of the tax |
| Trading without a required receipt | 25% of the tax due, on top of other penalties |
Here's the part people miss. Not renewing costs you less than never registering, but only just. Both end at 25%, and trading without any receipt adds that penalty to whatever else the local authority charges.
Who doesn't need a receipt
Section 205.066 says an individual who works as an employee of someone else doesn't need a local business tax receipt or an exemption. An independent contractor isn't an employee, so freelancers and contractors are in scope. The chapter also lists exemptions for some veterans and their spouses, low-income persons, certain disabled persons, the aged, and widows with minor dependents, plus nonprofit religious, charitable and educational activities. Your local tax collector applies these, so ask when you apply.
Regulated trades go state first
If your trade is regulated by the Department of Business and Professional Regulation, the Florida Supreme Court or another state agency, section 205.194 says you must show an active state certificate, registration or licence before the county or city will issue your receipt. Online renewals can let you certify this electronically. So a regulated business gets its state licence first, then its local receipt.
Selling, moving or changing hands
- Selling the business: a receipt can transfer to a new owner on a bona fide sale, for a transfer fee of up to 10% of the annual tax, at least $3 and no more than $25, as of October 2026.
- Moving within the county: a receipt can be transferred to a new location on written request with the original receipt and a transfer fee.
- Changing your trading name: section 205.023 requires you to report the status of your fictitious name registration.
Getting your receipt, step by step
- Check whether your trade needs a state licence or registration, and get that first.
- Contact your county tax collector for the county receipt.
- If you're inside city limits, check whether the city levies its own business tax.
- Register any trading name you use. My guide to DBA registration covers how fictitious names work.
- Put September 30 in your calendar for renewal every year.
If you're also forming a company, my Florida LLC guide covers that step, and my guide to business licences explains how other states handle this.

My verdict
Florida keeps business licensing local. Get any state licence your trade needs, then the county receipt, then the city one if you're inside city limits, and renew all of them by September 30. Leave it until October and you start paying 10%, rising to 25%.
Once you hire people, state registration for unemployment tax is the next job after the local receipt, and our Florida reemployment tax guide covers it.

Do I need a business license in Florida?
There's no general state business license. Most businesses need a local business tax receipt from their county, their city, or both, plus any state licence their trade requires.
When does a Florida business tax receipt expire?
Every receipt expires on September 30. Renewals go on sale from July 1 and are due on or before September 30.
What is the penalty for a late Florida business tax receipt?
10% for October, plus 5% for each further month, capped at 25% of the tax. Trading without a required receipt carries a 25% penalty.
Do employees need a Florida local business tax receipt?
No. Section 205.066 says employees don't need one. Independent contractors aren't employees, so they may need one.
