DBA in Arizona: How a Trade Name Works, and Why It's Optional

In Arizona a DBA is called a trade name, and you register it with the Arizona Secretary of State. Unlike most states, Arizona doesn't legally require one: the Secretary of State describes a trade name as not legally required but an acceptable business practice. A registration lasts 5 years and you can renew it in the six months before it expires.

So the real question in Arizona isn't whether you must file, it's whether you should. This guide covers what a trade name does and doesn't do, the registration rules in the state statute, and the renewal trap that lets someone else take your name, based on the official pages as they read in October 2026.

What an Arizona trade name gives you

The Secretary of State says a trade name registers a business name for public record. It's similar to a DBA, it doesn't grant exclusive rights to the name, and it isn't the same as a corporation or LLC. If you want to form one of those, you file with the Arizona Corporation Commission instead, not the Secretary of State.

What the statute asks for

Arizona Revised Statutes 44-1460 sets out the application. Anyone doing business in the state, from a sole trader to a foreign corporation, may register the name they operate under by giving:

  1. Their name, email and business address, plus the state of incorporation if they're a corporation.
  2. The name, title or designation being registered.
  3. The general nature of the business.
  4. How long the name has been used in their business in Arizona.
  5. A statement that they've searched and found the name distinguishable from names already on file and from existing or reserved corporation names.

Only one name goes on each application, and the applicant, or a member or officer of the business, signs it. Under 44-1460.01, the Secretary of State won't file a name that isn't distinguishable on the record from one already filed or from an existing corporate name.

Timing and expedite

Online filings that need review currently take 2 to 3 weeks according to the Secretary of State, and its filing-length notes mention 3 to 4 weeks for applications requiring review. If you're up against a launch date, the office offers expedited handling for an additional $25 fee with a turnaround of 2 to 3 days, as of October 2026. Customers are told to pay online by card or post a check with a copy of the application, never cash. From 2 November 2026, Phoenix in-person business services move to appointment only.

The renewal window, and why it matters

This is the part to diarise. Trade names last for 5 years from the date of receipt, and you have up to six months before expiry to renew. The Secretary of State is blunt about the risk: if your filing isn't renewed on time, your trade name can be registered by someone else. Renewals also have to match the owner already on file, and the owner can't be changed on a renewal, so a business that changed hands needs a new filing rather than a renewal.

Should you file one?

  • File if you want customers, banks and suppliers to find your trading name on a public record.
  • File if you'd like an earlier claim to the name on the state register, even though it isn't exclusive.
  • Consider a trademark instead, or as well, if you need stronger protection. The Secretary of State notes that state filings only apply in Arizona and points to the U.S. Patent and Trademark Office for national protection.
  • Form an LLC with the Corporation Commission if what you want is liability protection. A trade name won't give you that.

If you sell taxable goods or services, you'll also need to register for Arizona's version of sales tax, which my transaction privilege tax guide explains. For how assumed names work in states where they're compulsory, see my DBA registration overview.

Mistakes that cost Arizona businesses their name

  • Assuming a trade name stops a competitor using the same words. It doesn't grant exclusive rights, so check trademarks too.
  • Registering under one owner, then selling the business. A renewal must match the owner on file, so the buyer needs a fresh registration.
  • Waiting for the expiry date. The six-month renewal window opens well before it, and a lapsed name can go to someone else.
  • Putting two names on one form. Each application covers a single name, so a business with two brands files twice.
  • Treating the trade name as your company. Contracts still need your legal name or your LLC's registered name alongside it.

If you need proof of a filing later, the Secretary of State says a duplicate certificate is $3 through a public records request, and plain copies of applications on file are 10 cents a page, as of October 2026. Its search website doesn't show images of past filings, so keep your own copy of the certificate when it arrives.

My verdict

Arizona is one of the few places where a DBA is a choice, not a legal must. I'd still file if the name is how customers know you, because the public record helps and it's cheap insurance. Just set a reminder five months before the five-year mark: losing your trading name because a renewal slipped is a painful way to learn the rule.

Michigan splits the filing between the county and the state, which a Michigan assumed name sets out.
