Form 4852: What to File When Your W-2 or 1099-R Never Arrives

Form 4852 is the IRS substitute for a Form W-2, W-2c or 1099-R. You complete it yourself when your employer or payer never sends the form, or sends one that's wrong, and you attach it to your Form 1040, 1040-SR or 1040-X. Before you use it, the IRS expects you to ask the employer first and, if nothing arrives by the end of February, to call the IRS so it can chase the form for you.

Everything below comes from Form 4852 and its instructions (Rev. September 2020), the current revision as of October 2026.

The steps the IRS wants before Form 4852

  1. Ask your employer or payer for the missing or corrected Form W-2, W-2c or Form 1099-R.
  2. If it hasn't arrived by the end of February, call the IRS on 800-829-1040 with your name, address, phone number, SSN and dates of employment, plus the employer's or payer's name, address and phone number.
  3. The IRS contacts the employer or payer and also sends you a Form 4852.
  4. If the real form still doesn't arrive in time to file on schedule, file with the Form 4852 the IRS sent you.

That order matters. Line 10 of the form asks you to explain every attempt you made to get the missing form, so keep a note of dates and who you spoke to.

Line by line: W-2 replacement (line 7)

Use your final pay stub if you don't have complete figures. The instructions spell out what each box means:

LineWhat goes in it
7aTotal wages, tips and other compensation before deductions, including noncash income and reported tips
7bWages subject to employee social security tax, leaving out social security tips and allocated tips
7cMedicare wages and tips
7dSocial security tips
7eFederal income tax withheld
7f and 7gState and local income tax withheld, with the state or locality named
7hSocial security tax withheld, not the employer's share
7iMedicare tax withheld, including the 1.45% on all Medicare wages and the 0.9% Additional Medicare Tax above $200,000

Line by line: 1099-R replacement (line 8)

If the figures from a 1099-R are incomplete, the instructions point you to a distribution statement from your plan trustee. Line 8 covers the gross distribution, the taxable amount (or a box to tick if you can't work it out), whether it was a total distribution, any capital gain, tax withheld, your after-tax contributions recovered tax free and the distribution codes. If the payment came from a traditional, SEP or SIMPLE IRA, write IRA, SEP or SIMPLE in the right margin.

Lines 4 to 6 and line 9

  • Line 4: the tax year and which form you couldn't get, or got wrong.
  • Line 5: the employer's or payer's name and address.
  • Line 6: their taxpayer identification number if you know it. The instructions suggest using the EIN from last year's W-2 or 1099-R if it's the same employer.
  • Line 9: how you worked out the amounts, for example estimates, pay stubs or a distribution statement.

Will you have to amend later?

Possibly. If a W-2, W-2c or 1099-R turns up after you've filed, and it shows your return was wrong, you must amend with Form 1040-X. The instructions are blunt that you're responsible for an accurate return whether or not the employer ever sends the form.

Keep a copy of Form 4852 until you start receiving social security benefits. The IRS suggests it because it protects your earnings record; after 30 September of the following year you can check what employers reported through your Social Security online account.

Who should and shouldn't use Form 4852

Form 4852 fits two situations and only two: the employer or payer never issued a W-2 or 1099-R, or issued one with wrong figures. If the form you received is wrong, the instructions say you should always try to get a corrected form first. It isn't a way to report income from a 1099-NEC or other information returns, and it isn't a place to argue with figures that were reported correctly.

The penalties for misusing it

The IRS says it will challenge anyone who uses Form 4852 to dodge tax. The form lists accuracy-related penalties of 20% of the tax that should have been paid, civil fraud penalties of 75%, and a $5,000 penalty for a frivolous return or submission, as of October 2026. Form 4852 is for honest estimates from real records, not for rewriting what an employer reported.

The verdict

Form 4852 is a fallback, and a useful one. Chase the employer, make the call to the IRS after February, then fill the form from your last pay stub or plan statement and explain your method on line 9. File on time with it rather than filing late waiting for paperwork, and be ready to amend if the real form arrives with different numbers.
