Dave is a real US money app, and its terms say it isn't a bank but works with Coastal Community Bank, Member FDIC. Its ExtraCash advances go up to a limit, and few members qualify for the top amount. The catch is the fees: the FTC and Department of Justice have a pending case about how Dave describes advances and charges, which Dave disputes.
Dave is the app people turn to when payday feels a long way off, so the legit question usually comes with a worry: what will this really cost me? I've read Dave's terms, its ExtraCash help article, the federal case page and Dave's own response, and I'll set out what each says. This isn't financial advice. It's a guide to the things worth checking before you take an advance.
Who runs Dave and is it a bank
Dave's terms say Dave is not a bank, that banking services are provided by Coastal Community Bank, Member FDIC, or another partner bank, and that deposits are FDIC-insured up to 250,000 US dollars, subject to conditions. The terms name Dave Operating LLC, and the federal case I describe below names Dave, Inc. as the defendant.
So there's a named company and a partner bank behind it. The deposit insurance wording is specific to the bank account side, not to the advance. An advance is a different product, which is the next section.
How ExtraCash works
Dave's terms describe ExtraCash as advances from 25 to 500 US dollars. It's set up as an overdraft, which requires an ExtraCash overdraft deposit account and a Dave Checking account. The terms are frank about the limits: not all members qualify for ExtraCash, and few qualify for 500 US dollars.
Dave's help centre says that, based on eligibility, you can overdraw the account by up to 500 US dollars. So the number in the advert is a ceiling, not a promise. See the amount the app offers you before you plan around it.
What Dave charges
Fees are the heart of the question, and Dave's own pages don't line up perfectly, so read this section with the app open.
- Dave's terms list a membership fee of up to 5 US dollars per month for ExtraCash, Income Opportunity Services and Financial Management Services.
- Dave's help centre says there's an overdraft service fee of 5 US dollars or 5% of the transfer.
- The help centre says a 1.5% express fee is optional for transfers to external debit cards.
- The help centre says ExtraCash has no late fees or interest.
There's a wrinkle. Dave's investor statement, dated 31 December at the end of 2024, says a new fee structure eliminates optional tips and express fees for ExtraCash, with new members onboarded on or after 4 December moved to it and full implementation expected in early 2025. The help article I read still mentions the optional express fee. Which one applies to you depends on when you joined, so check the fee screen in the app before you accept an advance.
The FTC and Department of Justice case against Dave
This is the part to read carefully. The FTC's case page lists FTC v. Dave, Inc. as pending, in the Central District of California. In 2024, on 5 November, the FTC filed its complaint, alleging misleading marketing about the amount of cash advances, undisclosed fees and so-called tips charged without consent. On 30 December that year it referred the case to the Department of Justice, whose amended complaint names Dave's CEO, Jason Wilk, and seeks civil penalties.
An allegation isn't a finding. Dave's investor statement says the amended complaint isn't a new lawsuit and that Dave intends to vigorously defend itself. I couldn't find a ruling or settlement, so I'm not going to guess how it ends. If you want the latest, check the FTC's case page directly.
What Dave is and isn't good for
Dave is designed for small, short gaps in your money, not for planning your budget around. If you're a freelancer with lumpy income, the better question is what happens when a payment lands late and the advance repays automatically. Dave's help centre says ExtraCash has no late fees or interest, but the other fees above still apply, so run the total before you take one.

Fake Dave messages to avoid
Scammers use the names of money apps because people are stressed when they use them. Dave's pages describe an app that lends through your own account and a partner bank. They don't describe asking for gift cards, a login code over the phone, or a fee paid to a stranger to release your advance. If a message does any of that, close it and open the official app yourself.
So, is Dave legit
Dave is a real company with a partner bank and published terms. It also has a pending federal case, which it disputes, about how it describes advances and charges. If you use it, check the offered amount, the fee screen and your repayment date before you tap accept, and report problems to the CFPB or the FTC through their own sites.
