Paid Family Leave California: How Dads and Partners Get Paid to Bond

California Paid Family Leave (PFL) pays eligible workers, fathers included, for up to 8 weeks in a 12-month period to bond with a new child. As of October 2026 the weekly benefit runs from $50 to a maximum of $1,765, and it's paid by the state, not your employer.

That's the part most new dads in California don't realise: you don't need your employer to offer paternity pay. If you've paid into State Disability Insurance (it shows as CASDI on your payslip), the state's Employment Development Department (EDD) can pay you while you're off with the baby.

The catch is that PFL is a payment, not a right to keep your job. Job protection comes from a different law, and the two are often confused. Here's how both work, using the EDD's and the Civil Rights Department's own pages.

What California PFL pays a new parent

EDD says PFL provides short-term wage replacement when you take time off to bond with a new child, care for a seriously ill family member, or support a family member's military deployment. Bonding claims are open to birth mothers moving on from pregnancy disability benefits, new mothers, fathers, and foster or adoptive parents.

PFL ruleWhat EDD says (as of October 2026)
LengthUp to 8 weeks in any 12-month period
Weekly amountAbout 70 to 90% of your wages, depending on income
Minimum and maximum$50 a week up to $1,765 a week
Wages usedYour highest quarter of earnings, roughly 5 to 18 months before your claim starts
Earnings testAt least $300 in your base period with SDI withheld
Can you split it?Yes, you don't have to take the 8 weeks all at once
Bonding deadlineWithin one year of the birth, adoption or foster placement

Two details matter for dads. First, the length of time you've worked at your current job doesn't affect PFL eligibility, so a recent job change isn't a problem. Second, citizenship and immigration status don't affect eligibility either, according to EDD.

The job protection catch: PFL and CFRA are different things

EDD is blunt about it: PFL provides benefit payments but not job protection. Your right to return to your job usually comes from the California Family Rights Act (CFRA) or the federal Family and Medical Leave Act.

Under CFRA, the Civil Rights Department says eligible employees can take up to 12 work weeks of job-protected leave in a 12-month period for the birth, adoption or foster placement of a child. You're eligible if all three apply:

  • you have more than 12 months of service with your employer
  • you worked at least 1,250 hours in the 12 months before the leave starts
  • your employer has five or more employees

CFRA itself only guarantees unpaid leave, which is exactly why PFL exists alongside it: CFRA protects the job, PFL pays part of your wages for up to 8 of those weeks. If your employer is tiny or you're new, you might get PFL pay with no guaranteed job to go back to. That's worth knowing before you tell your boss your dates. For the federal rules on top, see my guide to how FMLA leave works.

How to claim PFL for bonding, step by step

  1. Check your payslip for the CASDI deduction. No SDI contributions usually means no PFL claim.
  2. Give your employer notice of your leave. The Civil Rights Department says employees must give 30 days' advance notice when possible for CFRA leave.
  3. Start your leave first. EDD says claims can be submitted no earlier than the first day of your family leave.
  4. File the Claim for Paid Family Leave (DE 2501F) online through myEDD or by mail, no later than 41 days after your first day of leave.
  5. Include proof of your relationship to the child with a bonding claim.
  6. Watch for payment. EDD says claims are processed about 14 business days after a complete application arrives, and most payments go out within two weeks.

If you're planning to split the 8 weeks, remember the one-year bonding window. EDD suggests filing no later than eight to nine weeks before the child's first birthday so the full entitlement fits inside the year.

Extra pay in San Francisco

EDD flags one local bonus: workers in San Francisco may get supplemental compensation from their employer while on PFL for bonding, under the city's Paid Parental Leave Ordinance. It's worth asking HR about if you work there.

How California compares with the rest of the US

There's no federal law in the US that guarantees paid family leave in the private sector, so California's scheme is the reason a California dad can be paid to bond while a dad in many other states can't. If you're comparing states, my overview of paternity leave in the UK shows how differently another country handles the same question, with a statutory payment set nationally.

My verdict

If you're a working parent in California and you pay SDI, claim PFL. You've already paid towards it through your payslip, and leaving it on the table is the most common mistake I see in parent groups. Just don't confuse the payment with job protection: check whether you meet the CFRA tests, give notice early, and file inside the 41-day window. For anything tricky, like a disputed claim or a small employer refusing leave, talk to EDD or the Civil Rights Department directly.

Figures in this guide are as of October 2026, from the EDD and Civil Rights Department pages listed above. The maximum weekly amount changes each January, so check EDD's page before you plan your budget.
