North Carolina Labor Laws: Wage, Paydays, Final Pay, Deductions and Teen Hours

North Carolina labor laws follow the federal $7.25 minimum wage as of October 2026, require overtime at time and a half after 40 hours a week, and say staff who leave must get their final pay by the next regular payday. Every worker under 18 needs a youth employment certificate.

The state's rules sit in the North Carolina Wage and Hour Act, sections 95-25.3 to 95-25.8 of the General Statutes, which I read in October 2026 alongside the U.S. Department of Labor's state tables.

Minimum wage and tipped staff

Section 95-25.3 sets the wage at $6.15 an hour or the federal minimum wage, whichever is higher, so the federal $7.25 applies. For tipped staff, the U.S. Department of Labor's table shows a cash wage of $2.13 and a maximum tip credit of $5.12, and the tip credit applies to workers who get more than $20 a month in tips. My North Carolina minimum wage guide goes further on who's covered.

Paydays and final pay

Section 95-25.6 says every employer must pay all wages and tips due on the regular payday. You can choose daily, weekly, bi-weekly, semi-monthly or monthly pay periods. Bonuses and commissions can be paid as rarely as once a year, but only if that's set out in advance.

When someone leaves for any reason, section 95-25.7 says they must be paid all wages due on or before the next regular payday. You can pay through the normal payroll channel, or by trackable mail if the employee asks in writing. Bonuses and commissions are due on the first regular payday after the amount can be worked out. They can only be forfeited if you told the employee about your forfeiture policy in advance.

The 7-day notice for shortage deductions

This is the rule that catches out shops and restaurants. North Carolina does let an employer recover cash shortages, inventory shortages, or loss or damage to its property from wages, but section 95-25.8 requires written notice of the amount to the employee seven days before the payday on which it's deducted. Other deductions need written authorization signed on or before the payday, giving the reason, and stating the amount or rate when it's known in advance. Deductions for the employer's benefit can bring pay down to the minimum wage level but no lower, and no reduction can be made to overtime wages owed.

Breaks

North Carolina isn't on the U.S. Department of Labor's list of states with meal period rules for adults, so adult breaks follow federal law. The exception is teenagers: section 95-25.5 says workers under 16 can't work more than five hours in a row without a break of at least 30 minutes. My lunch break laws guide covers the federal rule.

Rules for workers under 18

Age and situationLimit under G.S. 95-25.5
Under 18, school next day, grade 12 or lowerNo work between 11 p.m. and 5 a.m., unless a 16 or 17-year-old has written approval
14 and 15, school dayNo more than 3 hours
14 and 15, non-school dayNo more than 8 hours
14 and 15, school weekNo more than 18 hours
14 and 15, non-school weekNo more than 40 hours
14 and 15, time of dayOnly between 7 a.m. and 7 p.m., or 9 p.m. in summer
13 and underNot employed, except 12 and 13-year-olds delivering newspapers for up to 3 hours a day

Every worker under 18 needs a youth employment certificate unless exempt, and hazardous occupations are off limits under 18. Models and performers are exempt from most of these limits but still need the certificate.

  1. Work out the exact amount of the cash shortage, inventory shortage or damage.
  2. Give the employee written notice of that amount at least seven days before the payday it comes out of.
  3. Check the deduction won't take their pay below the minimum wage for non-overtime hours.
  4. Leave overtime wages untouched.
  5. Keep a copy of the notice with the payroll record.

Common North Carolina mistakes

  • Deducting a till shortage without giving 7 days' written notice first.
  • Holding final pay until a later payday than the next regular one.
  • Letting a 15-year-old work past 7 p.m. during the school year.
  • Taking deductions out of overtime wages.
  • Hiring under-18s without a youth employment certificate.

If you're also forming the business, my guide to starting an LLC covers that.

My verdict

North Carolina is light on adult break rules and strict on paperwork. Pay on a fixed schedule, pay leavers by the next payday, give 7 days' written notice before any shortage deduction, and keep a youth certificate on file for every teenager. Those four habits cover most of the wage complaints the state sees.
