Is OKX Legit? US Guilty Plea, Proof of Reserves and Scams (2026)

OKX is a real, long-running crypto exchange that has operated under that name since 2022. The key fact to weigh is that the US Justice Department says the entity behind it pleaded guilty in 2025 to operating an unlicensed money transmitting business. It's a custodial exchange, so you're trusting the company with your coins.

When someone asks me whether OKX is legit, I want the answer to include the uncomfortable parts, because crypto exchanges are places where trust is the whole product. I've looked at what OKX says about itself, what Wikipedia records and what the US Justice Department's case reporting says, and I've kept it factual. This isn't advice on whether to buy anything.

Who is behind OKX and where it started

According to Wikipedia, OKX started as Okcoin and was founded by Star Xu. It launched as OKEx in 2017 in Hong Kong, then rebranded to OKX in 2022. The same article says it stopped serving customers in Mainland China in 2021 and relocated its headquarters to San Jose, California in 2025, after originally being based in Beijing.

That history matters because OKX isn't a newcomer. It's been trading for several years and has changed base, branding and rules more than once, which is typical of a global exchange that has to answer to different regulators.

What OKX is: a custodial exchange

OKX is an exchange. When you deposit coins, they sit in accounts that OKX controls, which is the opposite of a self-custody wallet where only you hold the keys. That means you rely on the company to keep its systems safe and its books honest. If you want to understand the difference, my explainer on hot wallets and cold wallets covers where coins live and who can move them.

OKX's help centre says not all products mentioned are available in all jurisdictions, so what you can use depends on where you live. Check the site's own notices for your country before you sign up.

The OKX guilty plea and what prosecutors said

This is the biggest fact on the page. The US Attorney's Office for the Southern District of New York says Aux Cayes FinTech, the Seychelles-based entity behind OKX, pleaded guilty to one count of operating an unlicensed money transmitting business. AML Intelligence, reporting on the case, says the penalty was an 84.4 million US dollar fine plus a 420.3 million US dollar forfeiture, nearly 505 million US dollars in total, and that OKX must keep an external compliance consultant through 2027.

The same report says prosecutors claimed that from 2018 through early 2024 OKX was used to facilitate more than 5 billion US dollars of suspicious transactions and criminal proceeds. That's the prosecutors' claim, not OKX's own statement. The company's lawyers said the settlement contained no charges of money laundering and that it related to a missing money transmitter licence. Both sides of that are worth holding in your head.

Wikipedia notes that OKX relaunched its US exchange in 2025. A plea doesn't mean the platform can't be used, but it does mean you should read the compliance terms carefully.

OKX proof of reserves explained

OKX publishes a proof of reserves page. It says it holds a 1:1 reserve ratio and uses a zk-STARK zero-knowledge proof so users can check that their assets are included. The page doesn't name an outside auditor, so treat it as OKX's own published claim rather than an independent audit.

Proof of reserves shows that assets exist; it isn't deposit insurance. If you want a wider look at how exchanges, wallets and trackers differ, my comparison of crypto apps lays that out.

What I checkedWhat the record says
Who founded it?Star Xu, per Wikipedia, as Okcoin, then OKEx in 2017
Any US criminal case?Yes: guilty plea by Aux Cayes FinTech to an unlicensed money transmitting charge
Proof of reserves?Published by OKX, using zk-STARK, with no named auditor
Self-custody or exchange?Custodial exchange
Available everywhere? No, OKX says not all products are available in all jurisdictions

Fake OKX sites and support scams

Exchanges are prime targets for impersonators. OKX's own help article warns that hackers may create fake websites that closely resemble official software or service pages, and says to use devices and software from reputable sources only. Other habits that help:

  • Go to OKX by typing the address yourself, not by tapping an ad or a search result.
  • Never share your seed phrase or recovery words with anyone, including someone claiming to be support.
  • Treat unexpected prompts for a two-factor code as suspicious; OKX's help article says not to enter one-time codes you didn't request.
  • Ignore anyone promising profits or asking you to send coins first to release a withdrawal.

Where OKX points you for account safety

OKX's help centre has a fraud prevention section covering how to recognise fraudulent activity and fraudulent accounts, plus a section on safeguard measures against scams that target accounts and wallets. It also lists tools for managing your personal info, account status and security settings. Spend ten minutes there after you sign up, because a strong setup protects you from the most common loss: someone else getting into your account.

Risks to keep in mind with OKX

Even with a real company, crypto is risky. Prices can fall fast, and accounts can be hacked if your login is weak. I won't comment on prices or whether to buy, but I will say: only use money you can afford to lose, switch on every security option OKX offers and keep your recovery details offline.

My verdict on OKX

It's real and has a long track record, so I wouldn't call it a scam. But the 2025 guilty plea is a serious mark, and you're trusting a custodial exchange with your holdings. Read the plea details yourself, check what's allowed where you live and keep security tight.
