Form 2441 Explained: Child and Dependent Care Expenses Credit

Form 2441 is the IRS form for claiming the credit for child and dependent care expenses, and for excluding dependent care benefits your employer provides. As of October 2026, for 2025 returns you can count up to $3,000 of care costs for one qualifying person or $6,000 for two or more, and up to $5,000 of employer benefits can be excluded from income.

If you pay a nursery, a childminder, an after-school club or a carer so you can work, this form can cut your tax bill. The rules below come from the IRS's 2025 instructions and the 2025 form itself.

The five tests you must pass

  1. Your filing status is single, head of household, qualifying surviving spouse or married filing jointly (married filing separately only in limited cases).
  2. The care let you (and your spouse if filing jointly) work or look for work. If you didn't find a job and had no earned income, you can't claim, unless you or your spouse was a full-time student or disabled.
  3. The care was for one or more qualifying persons.
  4. The carer wasn't your spouse, the parent of your qualifying child or someone you can claim as a dependent. Your own child can be the carer only if they were 19 or older by the end of the year and aren't your dependent.
  5. You report the carer's details on line 1 and, for the credit, the qualifying person on line 2.

Who counts as a qualifying person

  • A qualifying child under 13 you can claim as a dependent. If they turned 13 during the year, they count for the part of the year they were under 13.
  • A spouse or dependent who wasn't physically or mentally able to care for themselves, subject to the residence and other conditions in the instructions.
  • Special rules let a child of divorced or separated parents count for the custodial parent even if that parent can't claim the child as a dependent.

The numbers for 2025 returns

ItemLimit
Care expenses you can count, one qualifying person$3,000
Care expenses you can count, two or more qualifying persons$6,000
Employer dependent care benefits you can exclude$5,000 ($2,500 if married filing separately)
Credit rate (decimal from the form's table)From .35 with AGI up to $15,000, falling to .20 over $43,000

These are from the 2025 Form 2441 and its instructions, as of October 2026. A useful quirk: the $6,000 limit applies when you have two or more qualifying persons even if all the costs were for one of them. The IRS example has a 3-year-old with $6,000 of care costs and an 11-year-old with none, and the full $6,000 still counts.

What costs count, and what doesn't

Qualifying expenses are for care. The cost of food, lodging, education, clothing or entertainment isn't included. Care outside your home counts for a dependent under 13, or for any other qualifying person who regularly spends at least 8 hours a day in your home. If the care was provided by a dependent care center, it has to meet the extra conditions in the instructions.

Timing matters too. Costs you incurred in 2025 but didn't pay until 2026 may increase your 2026 credit instead. Costs you prepaid in 2025 for care in 2026 can only be used for the 2026 credit.

Part II in plain English

  1. Add up the qualifying costs for each person on line 2 and cap the total on line 3 at $3,000 or $6,000.
  2. Compare it with your earned income, and your spouse's if filing jointly. A full-time student or disabled spouse is treated as having some earned income under the rules for lines 4 and 5.
  3. Find your decimal on line 8 from the table: .35 at AGI up to $15,000, stepping down to .20 above $43,000.
  4. Multiply line 6 by that decimal on line 9a, then enter the smaller of that or the tax liability limit from the Credit Limit Worksheet on line 11. That figure goes on Schedule 3 (Form 1040), line 2.

Employer dependent care benefits

If your employer runs a dependent care plan, the amount set aside appears in box 10 of your Form W-2. Part III of Form 2441 works out how much is tax-free and reduces the expenses you can use for the credit. The IRS example: $5,000 set aside, $4,950 reimbursed, so $50 is forfeited and goes on line 14.

The carer's details: don't skip line 1

For each carer you give a name, address and taxpayer identification number. Form W-10 is the standard way to ask for them. If you don't give correct, complete information, the credit and the exclusion can be disallowed, unless you can show you used due diligence trying to get it. More than three carers? Tick the box above line 1 and attach a statement.

Married but filing separately

Normally a married couple must file jointly to claim. You're treated as unmarried for this credit if, while filing separately, you lived apart from your spouse for the last 6 months of the year, your home was the qualifying person's main home for more than half the year, and you paid more than half the cost of keeping up that home.

Once you know roughly what the credit will be worth, it's worth reviewing your Form W-4 so your withholding reflects it.

My advice

Ask every carer for their details on Form W-10 at the start of the year, not in April. Keep receipts that separate care from meals, tuition or trips, because only the care counts. And if your employer offers a dependent care plan, compare it with the credit before you sign up, since the two share the same pool of expenses.

Hiring a nanny or carer on the books brings extra filing duties, so our guide to household employment taxes is worth reading.

Frequently asked questions

How much childcare can I claim on Form 2441?

For 2025 returns, up to $3,000 of expenses for one qualifying person or $6,000 for two or more, as of October 2026.

Can I pay a relative to look after my child and claim?

Yes, unless they're your spouse, the child's parent or your dependent. Your own child must be 19 or older and not your dependent.

Do summer camps or school fees count?

Education, food, lodging, clothing and entertainment costs aren't qualifying expenses. Only the care itself counts.

What if my childminder won't give me their tax number?

Show due diligence, for example by asking with Form W-10, or the credit may be disallowed.
