Form 1096 is the summary and cover sheet you send to the IRS with paper copies of Forms 1099, 1098, 5498, W-2G, 1097, 3921 and 3922. You only need it if you file on paper, and you can't file on paper at all once you have 10 or more information returns of any type in a year, because then you must e-file (unless you get a hardship waiver) and Form 1096 isn't used.
So for many small businesses the real question isn't how to fill in Form 1096, it's whether you need it. Here's how it works, when it's due, and the common errors the IRS lists for paper filings.
What Form 1096 does
The IRS processes paper information returns by machine. Form 1096 tells it who you are, what type of form is attached and the totals. The IRS says you must send Copy A of every paper Form 1097, 1098, 1099, 3921, 3922, 5498 and W-2G with Form 1096, and you don't use it to transmit electronically.
Do you need Form 1096? A quick check
| Your situation | Do you need Form 1096? |
|---|---|
| You're filing 10 or more information returns in the year, counting all types together | No. You must e-file, and e-filing doesn't use Form 1096 |
| You're filing fewer than 10 and choose to e-file through IRIS or FIRE | No |
| You're filing fewer than 10 on paper | Yes, one Form 1096 for each type of form |
| You've been granted a hardship waiver from e-filing | Yes, if you file on paper |
The 10-return count is combined. The IRS's own example: four Forms 1098 and six Forms 1099-A add up to 10, so you must e-file. The IRS's Form 8300 guide gives a similar example that includes payroll forms: five Forms W-2 and five Forms 1099-INT means the business must file its information returns electronically.
When Form 1096 is due
Form 1096 travels with the paper forms, so it's due when they are. The IRS general instructions for returns filed in 2026 set these dates:
| Paper forms you're sending | Due date with Form 1096 |
|---|---|
| Form 1099-NEC | February 2, 2026 (paper or electronic) |
| Most other 1099s, 1098, 1097, 3921, 3922, W-2G | March 2, 2026 on paper (March 31, 2026 if e-filing) |
| Forms 5498 | June 1, 2026 |
Those dates moved because the usual deadlines fell on a weekend. When a due date lands on a Saturday, Sunday or legal holiday, you file by the next business day. For returns filed in 2027, check the next edition of the IRS general instructions.
How to file Form 1096 on paper
- Order official forms. The IRS says you can't file a Form 1096 or Copy A of Forms 1098, 1099, 3921 or 5498 printed from its website, because they're scanned by machine. Use the official scannable versions.
- Group your forms by type. You need a separate Form 1096 for each type, so 1099-NEC and 1099-MISC go in separate bundles. Putting two types under one Form 1096 is on the IRS's list of common errors.
- Make sure the name, address and TIN on Form 1096 match the forms attached exactly.
- Send the whole page of Copy A, even if some forms on it are blank or void, and don't cut forms printed two or three to a sheet.
- Don't staple anything. Mail flat, not folded, to the IRS Submission Processing Center listed for your state. If you're sending several packages, number them and put Form 1096 in package 1.
- Found more forms later? Send them with a new Form 1096, without copying anything you've already filed.
What late or wrong filing costs
The penalty applies per information return, and Form 1096 doesn't protect you from it. As of October 2026, the IRS general instructions list these amounts for returns filed in 2026:
| When you file correctly | Penalty per return | Yearly maximum for small businesses |
|---|---|---|
| Within 30 days of the due date | $60 | $239,000 |
| More than 30 days late, by August 1 | $130 | $683,000 |
| After August 1, or not at all | $340 | $1,366,000 |
| Intentional disregard | At least $680 | No maximum |
A small business here means average annual gross receipts of $5 million or less over the last 3 tax years. The IRS also says an agent can sign Form 1096 for you, but that doesn't move the penalty risk off your business.
The simpler route: IRIS
The IRS runs IRIS, the Information Reporting Intake System, a free online portal for e-filing Forms 1099. You'll need an IRIS Transmitter Control Code, which needs an EIN to apply. If you'd rather use software, these 1099 filing tools handle the e-file for you, and if you're unsure which 1099 a contractor needs, 1099-MISC vs 1099-NEC sorts that out first.
The verdict
Form 1096 is a one-page cover sheet, but paper filing is fussy: official scannable forms only, one 1096 per form type, no staples, exact matching details. If you're filing more than a couple of 1099s, I wouldn't bother with paper at all. Set up IRIS, which is free, and Form 1096 drops out of your life. And once you reach 10 returns of any kind combined, you don't get the choice anyway.
