The BC Employment Standards Act sets the minimum rules for most workplaces in British Columbia: an $18.25 an hour minimum wage since June 1, 2026, overtime after 8 hours a day or 40 a week, 5 paid sick days a year after 90 days, 2 weeks' vacation after a year and written notice or pay when a job ends. Contracts can give more, never less.
I've pulled the core rules from the Government of British Columbia's employment standards pages and the Act itself, which BC Laws shows as current to October 20, 2026. The Act doesn't cover everyone, so the province's "do the standards apply" check is worth running first for unusual roles.

Getting paid
Pay periods can't be longer than 16 days, and everything earned, including overtime and statutory holiday pay, has to be paid within 8 days after the pay period ends. Direct deposit needs the employee's written agreement or a collective agreement. Every payday comes with a pay statement, and the employer keeps a record of the hours each person works.
Hours, breaks and rest
- Schedule at least 2 hours for any shift, and pay 2 hours if someone reports for work and there's nothing to do.
- Give a 30-minute meal break after 5 hours in a row. It's unpaid unless the employee has to work or be available during it.
- Fit split shifts inside a 12-hour window.
- Leave at least 8 hours off between shifts, and 32 hours in a row free each week. Work inside either gap costs extra.
- No coffee breaks are required.
Statutory holidays in BC
BC has 11 statutory holidays in 2026, including B.C. Day on August 3 and the National Day for Truth and Reconciliation on September 30. Easter Sunday, Easter Monday and Boxing Day aren't statutory holidays in BC, which surprises people moving from other provinces.
Who qualifies for statutory holiday pay
Section 44 sets a two-part test. The employee must have been employed for at least 30 calendar days before the holiday, and have worked or earned wages on 15 of the 30 calendar days before it, or worked under an averaging agreement in that period. Qualifying staff who get the day off are paid an average day's pay. Those who work it get time and a half for up to 12 hours, double time beyond that, plus an average day's pay.
An employer and the employee, or a majority of employees, can agree to swap a statutory holiday for another day off. The substitute day then carries the same rights, and the agreement has to be kept on file for 4 years.
Averaging agreements
Overtime can be calculated over 1, 2, 3 or 4 weeks instead of daily, but only under a written averaging agreement signed before its start date that sets out the schedule for each day, the number of weeks it covers, how many times it can repeat, and its start and expiry dates. If any of that is missing, the standard daily and weekly overtime rules apply.
Leaves of absence
Most leaves under the Act are unpaid but job-protected, and most don't need a minimum length of service. Paid sick leave is the exception on both counts. Others include up to 27 weeks for a serious personal illness or injury, 5 unpaid days of family responsibility leave each employment year, 17 weeks of maternity leave and up to 62 weeks of parental leave, plus compassionate care and critical illness leave.
Ending employment
An employer can end a job with written working notice, pay in place of notice (called compensation for length of service), or a mix. Nothing is owed after a quit, a retirement or a dismissal for just cause. Final wages are due within 48 hours when the employer ends the job and within 6 days when the employee quits. Group terminations of 50 or more people at one location within two months need written notice to each employee, the Minister of Labour and any union.

The deadline people miss
A complaint about a job that has ended must reach the Employment Standards Branch in writing within 6 months of the last day of employment. Section 74 lets the director extend that only in special circumstances where an injustice would otherwise result, so don't count on it.
My verdict
BC's standards give employees daily overtime, double time and paid sick days, and the province is strict on timing: 8 days to pay wages, 48 hours for final pay. Build those clocks into payroll, and keep written copies of every averaging, banking and holiday substitution agreement. Compare the federal and provincial rates on the BC minimum wage page, and check BC statutory holidays for how holiday pay works.
