The Employment Law Situations That Blindside UK Small Business Owners (2026)

Nobody starts a business because they want to get good at employment law. You start it for the product, the clients, the freedom. Then you hire your first person, and quietly you have become an employer, with all the legal weight that carries, and usually with none of the training.

That is fine while everyone is happy. The trouble is that employment problems do not arrive when it is convenient. They arrive when you are already stretched, they arrive fast, and they are far more expensive to fix than to prevent. Here are the situations that catch UK small business owners out most often, and how to stay a step ahead of each one.

1. Redundancy handled badly

When money gets tight, redundancy feels like the simple lever to pull. It is anything but simple. Get the process wrong, skip the consultation, pick people using criteria you cannot defend, and a cost cutting exercise turns into an unfair dismissal claim that costs far more than the salary you were trying to save.

The rules on fair selection, proper consultation and notice are strict, and they apply even if you are only letting one person go. This is the one area where owners most often assume they can wing it, and it is the one that bites hardest. If you are anywhere near this, get proper guidance before you say a word to the person involved. Notice periods, restrictive covenants, probation terms, disciplinary procedures. These are the clauses that decide whether you are covered or exposed when something goes wrong. Getting them right is cheap. Discovering they are wrong in the middle of a dispute is not.

4. The problem that lands at the worst possible time

Here is the pattern nobody warns you about. The serious stuff rarely happens during office hours. The resignation letter that threatens a claim, the accusation between two staff members, the person who walks out mid shift. It happens on a Friday evening, and you are sitting there with a decision to make and nobody sensible to ask.

That is the real argument for having proper support in place before you need it. Acas is the government backed advisory service for workplace relations, and its guidance is the reference point tribunals themselves look to. CIPD is the professional body for HR in the UK. Use it as a library of sensible, current guidance, and as a quality check when you are hiring anyone to handle your people, since CIPD accreditation tells you they are the real thing.

How to stay ahead of all of it

You do not need an HR department. You need two things. First, the free knowledge, so you understand the basics and stop making avoidable mistakes. Second, a route to proper advice you can reach the moment something serious happens, whether that is redundancy guidance built for employers or someone on the end of a phone out of hours.

The owners who get burned are almost never the reckless ones. They are the good, busy people who meant to sort their HR out and never quite got to it before the problem arrived. The cheapest possible time to fix this is now, while nothing is on fire. Sort it before you need it, and most of these situations stop being emergencies at all.
