Meal Break California Rules: 30 Minutes After 5 Hours and the 1-Hour Premium

California meal break law requires a 30-minute meal period for any employee who works more than five hours in a day, starting no later than the end of the fifth hour. A second 30-minute meal period is required after more than ten hours, and an employer that fails to provide one owes the employee one extra hour of pay at their regular rate for that workday.

The rules come from California Labor Code section 512 and the Industrial Welfare Commission wage orders, and this page uses the California Labor Commissioner's meal period and rest period FAQs, read in October 2026. The insight most employers miss is that offering a break isn't enough. The employer has to relieve the employee of all duty and give up control of their time.

Employees in the motion picture industry covered by IWC Order 12-2001 have a different trigger: a meal period after six hours rather than five.

When the break has to start

  1. The first meal period must start no later than the end of the employee's fifth hour of work, which means before the sixth hour begins.
  2. The second meal period, for shifts over ten hours, must start no later than the end of the tenth hour.
  3. Each meal period must last at least 30 minutes, uninterrupted.

What counts as a real meal break

The Labor Commissioner says an employer isn't required to make sure no work is done, but it must do more than make a meal period available. It has to relieve employees of all duty, give up control over their activities, allow a reasonable chance to take an uninterrupted 30-minute break in which they're free to come and go, and not impede or discourage them.

If the employer requires the employee to stay at the work site during the meal period, the meal period must be paid, even if the employee is relieved of all work duties. If an employee is fully relieved and freely chooses to keep working, the employer doesn't owe the premium, but it does owe pay for the time worked, including any overtime.

On-duty meal periods

An on-duty meal period, where the employee eats while working, is counted as hours worked and paid at the regular rate. It's only allowed when the nature of the work prevents the employee from being relieved of all duty, and when the employer and employee sign a written agreement. That agreement must state the employee can revoke it in writing at any time. The Labor Commissioner says the test of whether the nature of the work prevents relief is an objective one.

Employees can't skip their meal period to leave 30 minutes early. The Labor Commissioner's FAQ says working through the meal period doesn't entitle anyone to leave before the scheduled quitting time.

The one-hour premium for missed breaks

Under Labor Code section 226.7, an employer that fails to provide a required meal period must pay one additional hour of pay at the employee's regular rate for each workday the meal period isn't provided. That extra hour isn't counted as hours worked for overtime. The California Supreme Court held in Murphy v. Cole that this premium is a wage with a three-year statute of limitations, so claims can be filed up to three years after the violation.

Rest breaks sit alongside meal breaks

Rest periods are a separate rule. Non-exempt employees must be authorised and permitted to take a net ten consecutive minutes of paid rest for each four hours worked or major fraction of four, taken in the middle of each work period where practicable. A rest period isn't required when total daily work time is less than three and one-half hours. Missing rest periods also triggers one additional hour of pay for that workday.

The Labor Commissioner adds that a net ten minutes begins when the employee reaches an area away from the work area that's suitable for rest. My lunch break laws guide compares California's rules with the rest of the country.

Facilities for meal breaks

Where employees must eat on the premises, the employer must designate a suitable place for it. For meal periods on shifts that begin or end between 10 p.m. and 6 a.m., most wage orders require facilities for securing hot food and drink or heating food or drink, plus a suitable sheltered place to eat.

My verdict

California meal break law comes down to timing and control. Start the 30-minute break before the end of the fifth hour, let the employee leave and do what they like, and schedule a second break for shifts over ten hours. When a break is missed, pay the extra hour on the same paycheck. For pay rates, my California minimum wage guide has the current figures.
