In South Carolina, a business license comes from your city or county, not the state. State law, the Business License Tax Standardization Act, makes every license run from May 1 to April 30 and requires renewal before May 1. The license tax is based on your gross income, and new businesses pay on an estimate for the rest of the license year.
Since January 1, 2022, every South Carolina county and municipality that charges a business license tax has had to follow one standard set of rules in sections 6-1-400 and 6-1-410 of the state code. The rates still vary by place, but the calendar, the income base and the appeal process are the same everywhere.
Who issues a South Carolina business license
The statute defines a business license as one issued by a county or municipality for the privilege of doing business there. The local body that charges the tax is called the taxing jurisdiction. So the questions to ask are local: is your business inside a city's limits, in unincorporated county land, or doing work in several places? Each jurisdiction that levies the tax can require its own license.
The statute's definition of taxpayer is broad: individuals, partnerships, LLCs, corporations, trusts, estates and associations are all covered. Being a sole trader doesn't exempt you. If you're not sure whether you need a license at all, my guide on whether you need a business license covers the general rules.
The license year and the May 1 deadline
| Date | What happens |
|---|---|
| May 1 | The license year starts |
| April 30 | Every license expires (construction project licenses can end with the project) |
| Before May 1 | Renewal and tax payment are due; after that, penalties can apply |
| Before June 1 | Deadline to ask for a refund of any overpayment |
Admitted insurance companies get until June 1 to pay without a penalty. Everyone else should treat May 1 as the hard date.
How the license tax is worked out
The tax is calculated on gross income, which the act defines as gross receipts or revenue from business done within the jurisdiction for one calendar or fiscal year. You can base it on:
- The calendar year before the due date,
- Your twelve-month fiscal year before the due date, or
- A twelve-month projection from your monthly average, if you've been trading for less than a year.
A new business pays on its estimated probable gross income for the rest of the license year. Taxes you collect for a government, escrow funds and funds that belong to someone else don't count as gross income.
The insight most people miss: you aren't taxed twice on the same income
If you pay a business license tax to another county or municipality, the act says the income taxed there must be taken off your gross income in the jurisdiction where you're domiciled. And a jurisdiction where you aren't based can only count income earned inside it. For a contractor or consultant working across several towns, this is the rule that stops the same revenue being licensed twice, but you have to report it to get the reduction.
Who's exempt or treated differently
- Wholesalers are exempt unless they keep a warehouse or distribution establishment in the jurisdiction.
- Charitable organizations are exempt on income from their charitable purpose, but not on for-profit or unrelated business income.
- Agents are taxed on gross commissions they keep, and insurers on gross premiums written.
- Construction contract licenses can be issued per project, at the taxpayer's option.
One application, one portal
Every jurisdiction must accept a standard business license application set by the state's Revenue and Fiscal Affairs Office, and must adopt, by ordinance by December 31 of every odd year, the latest standardized business license class schedule recommended by the Municipal Association of South Carolina. Jurisdictions also have to let you report and pay through the state's business license tax portal, as well as in person, by phone, by mail or through their own older online systems.
If you disagree with an assessment
- If you don't pay by May 1, the jurisdiction can serve a notice of assessment.
- Within thirty days, you can ask in writing, with reasons, for an adjustment. An informal conference must happen within fifteen days.
- A notice of final assessment follows within five days of the conference.
- Within thirty days of that, you can appeal by filing the form and paying at least 80% of the assessed tax under protest.
- The council or its appeals body must hear it within thirty days, and you can then go to the Administrative Law Court.

My verdict
South Carolina's system is more predictable than it used to be: one calendar, one application and one income base everywhere. Find out which jurisdictions you work in, renew before May 1 every year, and claim the reduction for income already licensed elsewhere. That last step is the one that saves multi-town businesses the most.

Frequently asked questions
Does South Carolina have a state business license?
Business licenses are issued by counties and municipalities. State law sets the common rules they must follow, but the license itself is local.
When do South Carolina business licenses expire?
Every license expires on April 30 and must be renewed before May 1, apart from construction project licenses, which can end with the project.
How is the South Carolina business license tax calculated?
On gross income from business done in the jurisdiction, using the prior calendar or fiscal year, or a projection for a business under a year old.
Do I pay business license tax twice if I work in two towns?
No. Income taxed by another county or municipality is deducted from your gross income where you're domiciled.
Are wholesalers exempt from South Carolina business license tax?
Yes, unless they keep a warehouse or distribution establishment within the taxing jurisdiction.
Can I get a refund if I overpaid South Carolina business license tax?
Yes. Request it before June first, and the jurisdiction must issue the refund within thirty days of your request.
Do new businesses pay South Carolina business license tax?
Yes. A new business pays on its estimated probable gross income for the balance of the license year.
How do I appeal a South Carolina business license assessment?
Ask in writing for an adjustment within thirty days, then appeal the final assessment within thirty days by paying at least 80% under protest.
