Paid Family Leave New York 2026: Benefit Cap, Eligibility and Cost

New York Paid Family Leave gives eligible employees up to 12 weeks of job-protected, paid time off to bond with a new child, care for a seriously ill family member or help when a relative is deployed. As of October 2026 it pays 67% of your average weekly wage, capped at $1,228.53 a week, and it's funded by employee payroll deductions.

The part New Yorkers find surprising is that you've already been paying for it. It isn't an employer perk. It's insurance, and the deduction is on your pay stub.

Here's how the 2026 numbers work, who qualifies and what to do first, all from the state's own Paid Family Leave site.

New York PFL in 2026 at a glance

RuleWhat New York says (as of October 2026)
LengthUp to 12 weeks, all at once or in full-day increments
Pay67% of your average weekly wage, up to the cap
Weekly cap$1,228.53, which is 67% of the 2026 state average weekly wage of $1,833.63
Maximum total benefit$14,742.36
Employee contribution0.432% of gross wages per pay period, up to $411.91 a year
ProtectionsJob protection, continued health insurance and protection from retaliation

The 2026 cap is $51.21 a week higher than 2025, because the benefit rises with the New York State Average Weekly Wage.

What you'd get at different wages

The state publishes worked examples, and they're the quickest way to see where you'd land:

Your average weekly wageWeekly PFL benefit (2026)
$600$402
$1,000$670
$2,000$1,228.53 (capped)

Here's the insight most people miss: anyone earning above the state average weekly wage of $1,833.63 hits the cap, so higher earners get well under two-thirds of their pay. If you earn $2,000 a week, the cap means you replace a little over three-fifths of it, not two-thirds. Plan your savings around the capped figure, not the headline percentage.

What New York PFL covers

New York enacted its Paid Family Leave law in 2016, and the state calls it the nation's strongest and most comprehensive policy. It gives eligible employees job-protected, paid time off to:

  • bond with a newly born, adopted or fostered child
  • care for a family member with a serious health condition
  • assist loved ones when a spouse, domestic partner, child or parent is deployed abroad on active military service

Those three reasons are the full list. If the time off is for your own recovery, PFL isn't the claim to make, so check with your employer what applies instead.

Who's eligible in New York

  • Full-time employees who work a regular schedule of 20 or more hours a week are eligible after 26 consecutive weeks of employment.
  • Part-time employees working under 20 hours a week are eligible after 175 days worked, which don't need to be consecutive.
  • Once you're eligible, you stay eligible with that employer until the job ends. A new job resets the clock.
  • Approved vacation, sick or personal time counts towards the weeks, as long as contributions were paid for that time.

The state also says citizenship is never a factor in eligibility.

How to apply for New York PFL

  1. Check you meet the time-worked test: 26 consecutive weeks at 20 or more hours a week, or 175 days if you work fewer hours.
  2. Estimate your benefit with the state's PFL 2026 Benefits Calculator, so you know where the cap leaves you.
  3. Tell your employer as early as you can. It's your employer's insurance that pays, so they need to be in the loop.
  4. Find your employer's Paid Family Leave insurance carrier. The state says you can search by employer name on the Workers' Compensation Board website.
  5. Apply through that carrier, which decides the claim and pays the benefit.

What the deduction costs you

The state gives two examples at different pay levels. An employee earning $519 a week contributes about $2.24 a week and, when taking leave, receives $347.73 a week, up to a maximum total of $4,172.76. An employee earning $1,000 a week contributes about $4.32 a week. Anyone earning less than the state average weekly wage pays less than the $411.91 annual cap, in line with actual wages.

Timing rules for bonding leave

Bonding leave must be taken, and completed, within the first 12 months after the birth, adoption or foster placement, as long as you're still an eligible, covered employee. You can take up to 12 weeks in any 52-week period on a rolling basis. So if you used the full 12 weeks, the state says the next time you can take PFL again is one year from your first day of leave.

I build the systems that handle the boring 80 percent, so you get your week back. Done properly, with the human kept in.

That rolling year catches out parents who used PFL to care for a relative and then have a baby a few months later. Check your dates before you plan the second leave.

How it fits with FMLA

PFL and the federal Family and Medical Leave Act can run at the same time. FMLA gives eligible workers unpaid, job-protected leave, while New York PFL is the paid part. See my guide to how FMLA leave works for the federal rules, and if you're comparing pay rules more widely, New York's minimum wage is the other number most workers ask about.

My verdict

If you work in New York and you've been in your job for 26 weeks, you're very likely covered, and you've been paying for it all along, so use it. Just do the maths on the cap before you plan a 12-week leave on two-thirds of your salary, because above $1,833.63 a week the percentage drops. Give your employer as much notice as you can, and keep copies of everything you send the carrier.
