Prenuptial Agreements in the UK: Are Prenups Legally Binding?

A prenuptial agreement isn't automatically legally binding in England and Wales, but courts will usually uphold one that both of you entered freely, understood fully and that's still fair when you split. That rule comes from the Supreme Court's 2010 Radmacher v Granatino judgment.

So a prenup is a strong piece of evidence, not a guaranteed contract. Whether it holds depends on how it was made and whether following it would leave either of you, or your children, unfairly short.

This guide explains the current law using the House of Commons Library and Law Commission material, what makes a prenup more likely to stand, and where reform has got to.

What a prenup is

The House of Commons Library defines a pre-nuptial agreement as an agreement a couple make before they marry or enter a civil partnership, setting out how they want their assets divided if they divorce or dissolve the partnership. Agreements made during the marriage are called post-nuptial agreements, and ones made at the end are separation agreements.

Are prenups legally binding in the UK?

Not automatically. The Library says prenups aren't automatically enforceable in the courts of England and Wales. They were traditionally treated as unenforceable because they went against public policy. That changed with Radmacher v Granatino in 2010.

In that case the Supreme Court said courts should give effect to a prenup that each party entered freely, with a full appreciation of its implications, unless in the circumstances at the time it would not be fair to hold them to it. The Law Commission summarises this as giving agreements "decisive weight" unless they're unfair.

The detail people miss is that the court still has the final say. A judge dealing with a divorce has very broad discretion to redistribute property and income, and the agreement is one factor, often the deciding one, rather than the end of the discussion.

What makes a prenup more likely to hold

The courts look at how the agreement was made. The Law Commission's 2014 report recommended a new type of "qualifying nuptial agreement" that would be enforceable, and its conditions are a sensible checklist for any prenup today:

FactorWhy it matters
Freely enteredNo pressure, no last-minute signing under duress
Full understandingBoth of you understood what you were giving up
Financial disclosureEach of you knew what the other owned and earned
Independent legal adviceEach of you had your own lawyer, not a shared one
Signed well before the weddingSigning days before the ceremony looks like pressure
Meets needsIt doesn't leave either of you or the children without enough to live on

The last row is the big one. Under the Law Commission's proposal, a qualifying agreement still couldn't contract out of meeting the financial needs of either party or the children. Courts take the same approach now: a prenup that protects a business or an inheritance is far more likely to be followed than one that leaves a spouse with nothing.

Has the law changed yet?

Not yet. The Commons Library says the government hadn't given its final response to the 2014 qualifying nuptial agreements recommendation, and in April 2023 a justice minister said the government didn't intend to legislate on prenups while a new Law Commission review of finances on divorce was under way. The Law Commission's own project page still says it awaits a final response.

So for now, a prenup's strength comes from Radmacher and from how carefully it was put together.

How to get a prenup in place

  1. Talk about it early, months before the wedding rather than weeks.
  2. List what you each want to protect, for example a business, a property, savings or an inheritance.
  3. Swap full financial disclosure, including pensions.
  4. Each instruct your own family solicitor.
  5. Agree terms that still meet both of your needs, and any children's.
  6. Sign well ahead of the wedding and review it after big life changes, such as having a baby.

If you run your own business, how it's structured matters too. My guide to sole trader versus limited company explains why a company's shares are easier to identify and protect than a sole trader's personal assets.

Prenups and civil partnerships

The same principles apply to civil partners. The Commons Library treats agreements made before a civil partnership in the same way as those made before a marriage, and the Law Commission's work covered divorce and the dissolution of civil partnerships together. So if you're entering a civil partnership and want to protect a business or property, the checklist above applies in full.

One more practical point: a prenup works best alongside good records. Keep evidence of what you each brought into the relationship, such as account statements and property valuations, because that's exactly what a court will ask about years later.

If you divorce without a prenup

GOV.UK says that if you agree how to divide your assets, you make it binding with a consent order approved by a court. If you can't agree, you can ask the court to make a financial order. Pensions are often part of that split, so my workplace pension guide is worth reading before any negotiation.

My verdict

If you've built a business, own property or expect an inheritance, a prenup is worth the awkward conversation. Treat it as evidence you'll need a court to respect: disclose everything, both take independent advice, sign well before the wedding and keep it fair. A one-sided agreement signed in a hurry is the one most likely to fail. This guide explains the law in general terms; for your own agreement, speak to a family solicitor.

Frequently asked questions

Are prenups legally binding in the UK?

Not automatically in England and Wales. Since Radmacher v Granatino in 2010, courts usually give effect to a prenup entered freely and with full understanding, unless holding you to it would be unfair.

What makes a prenup valid in England?

Courts look at whether it was entered freely, both understood it, there was financial disclosure and independent legal advice, it was signed well before the wedding and it still meets both parties' needs.

Can a prenup protect my business?

It can help. Courts are more likely to follow an agreement that protects a business or inheritance while still meeting the other spouse's and children's needs.

Is the law on prenups changing?

Not yet. The Law Commission recommended binding qualifying nuptial agreements in 2014, but the government hasn't made its final response.

When should I sign a prenup?

Well before the wedding. Signing shortly before the ceremony can look like pressure, which weakens the agreement.
