Form 2350: The Tax Extension for Americans Working Abroad

Form 2350 asks the IRS for extra time to file your US tax return when you're a citizen or resident alien living abroad who expects to qualify for the foreign earned income exclusion, but won't meet the bona fide residence test or physical presence test until after your return is due. The extension usually runs to 30 days after the date you expect to meet the test. It doesn't extend the time to pay, so tax not paid by the regular due date still collects interest.

Everything below comes from the IRS's 2025 Form 2350 and the instructions printed with it, as of October 2026.

Form 2350 or Form 4868?

UseWhen
Form 2350You expect to file Form 2555 and need time to meet the bona fide residence or physical presence test for the foreign earned income exclusion or the foreign housing exclusion or deduction
Form 4868Every other taxpayer who wants an automatic extension of time to file

Don't file Form 2350 more than once for each move overseas. Once you've met the test and stay abroad in later years, use Form 4868 if you need more time.

Who should file it

The instructions say you should file Form 2350 if all three of these apply:

  1. You're a US citizen or resident alien.
  2. You expect to qualify for the foreign earned income exclusion, the foreign housing exclusion or the deduction by meeting the bona fide residence or physical presence test, but not until after your return is due.
  3. Your tax home is in a foreign country throughout your period of bona fide residence or physical presence.

How long the extension lasts

Here's the part most people don't expect. This isn't a fixed-length extension. If it's approved, it generally runs to 30 days after the date you expect to meet the residence or presence test. If you need to allocate moving expenses, the extension can be up to 90 days after the end of the year following the year you moved abroad. You can file your return any time before the extension ends.

You were 'out of the country' on the regular due dateJune 15, 2026

'Out of the country' means that on the regular due date you lived outside the United States and Puerto Rico with your main place of work outside them too, or you were on military or naval duty outside them. That gives you an automatic 2 extra months without a form, though you attach a statement to your return explaining how you qualified. File Form 2350 early enough that, if it's refused, you can still file on time.

Paying, interest and the late payment penalty

Form 2350 doesn't extend the time to pay. You owe interest on any tax not paid by the regular due date, even with the 2-month out-of-the-country extension, and it runs until you pay. The late payment penalty is charged for each month or part of a month the tax is unpaid, up to a maximum of 25%, unless you show reasonable cause. You can pay with the form and enter the amount on it.

What the form asks you

The form is short. Besides your name, address and SSN, with a foreign address split into city, country and postal code, it asks:

  • the date you're asking for, and whether you expect to meet the bona fide residence or physical presence test
  • whether you've already been granted an extension for this tax year
  • whether you need extra time to allocate moving expenses
  • the date you first arrived in the foreign country, when your qualifying period begins and ends, and your foreign home address
  • the date you expect to return to the United States, and any tax you're paying with the form

If you pay with the form, you claim that payment on Schedule 3 (Form 1040), line 10, when you file. And be accurate: the instructions warn that if the IRS later finds the statements false or misleading, the extension is void and the late filing penalty applies. That penalty is usually 5% of unpaid tax for each month or part of a month the return is late, up to 25%, and if the return is more than 60 days late the minimum is $525 or the tax due, whichever is smaller, as of October 2026.

Filing it

  • E-file is the IRS's recommended way, and you'll get an electronic acknowledgment. Have last year's return to hand for verification.
  • On paper, mail it to the Department of the Treasury, Internal Revenue Service, Austin, TX 73301-0045, or hand it to an IRS employee.
  • Fiscal year taxpayers must use the paper form.
  • Fill in the return label so the IRS can send back the Notice to Applicant saying whether it's approved.

If the IRS turns the request down, the notice may still grant a 45-day grace period, which counts as a valid extension for elections that would otherwise have to be made on a timely return. An extension of your 2025 income tax return also extends the time to file a 2025 Form 709 gift tax return, but not to pay any gift tax.

The verdict

Form 2350 solves a timing problem specific to people who've just moved abroad: you can't claim the exclusion until you've been there long enough, but your return is due before then. File it once for the move, pay what you can by the regular date to keep interest down, and switch to Form 4868 in later years.
