You need a Texas sales tax permit from the Texas Comptroller if you sell or lease tangible goods in Texas or sell taxable services. The permit lets you collect the 6.25% state sales tax plus up to 2% in local tax, and you apply online through the Comptroller's eSystems.
The Comptroller of Public Accounts runs sales and use tax in Texas. This page uses its sales and use tax page, its permit application page and Publication 96-259 on taxable services, all read in October 2026.

Who needs a Texas sales tax permit
The Comptroller's permit page says you need one if you sell or lease tangible personal property in Texas, or sell taxable services. Tangible goods are the obvious part. Services are where people get caught. Publication 96-259 lists 16 broad categories of taxable services under Tax Code section 151.0101, including data processing, information services, debt collection, credit reporting, some repair and remodelling of non-residential property, parking and storage, and amusement services such as sightseeing tours.
Here's the insight most new owners miss: some services are only partly taxed. The Comptroller says 20% of the charge for data processing services is exempt, and the same is true for information services. So a data processing firm collects tax on 80% of the charge, not all of it, and not none of it.
What you need before you apply
The online application lists the documents to have ready:
- Social Security numbers for sole owners, or for each officer or director of a corporation.
- Social Security numbers or federal employer identification numbers for each partner in a partnership.
- A Texas Secretary of State file number for a Texas corporation.
- A North American Industry Classification System (NAICS) code for your business.
If you're forming a company first, my Texas LLC guide covers the Secretary of State filing, and my EIN guide covers the federal number.
How to apply, step by step
- Check that you're 18 or older. A parent or legal guardian can apply for a permit on behalf of a minor.
- Gather the numbers and NAICS code listed above.
- Apply online through the Comptroller's eSystems. If a sole owner, partner, officer or director has no Social Security number, use form AP-201 instead and email or fax it to the Comptroller.
- Wait for your permit by post. The Comptroller says permits are usually printed the next business day and arrive in 7 to 10 business days.
- Read the approval letter, which tells you whether you'll file monthly or quarterly.
Filing dates, discounts and penalties
Once you hold a permit, the Comptroller sets your filing frequency. Monthly returns are due on the 20th of the month after the reporting month, so April's return is due May 20. Yearly filers report the previous year by January 20. If a due date falls on a weekend or legal holiday, the next working day is the due date.
There's a small reward for paying on time. Permit holders can claim a discount of 0.5% of the tax timely reported and paid, and those who prepay can add 1.25% on top. Late filing costs more:
- A $50 penalty on each report filed after the due date.
- A 5% penalty if tax is paid 1 to 30 days late.
- A 10% penalty if tax is paid more than 30 days late.
- Interest on past-due tax from 61 days after the due date.
Why new permit holders get sales calls
The Comptroller warns about something that confuses many new owners. Texas law requires it to release public information, including a permit holder's phone number, and it gets weekly requests for lists of new permits. It doesn't sell the data, and the law stops it from asking what requesters plan to do with it. The Comptroller says the calls usually die down within a week or two.
Duplicate permits and keeping details current
Online sellers should check the Comptroller's remote seller rules as well, since sellers outside Texas can also have duties to collect. The sales and use tax page links to its remote seller search and guidance.
Want AI doing the heavy lifting in your marketing?
I build the systems that handle the boring 80 percent, so you get your week back. Done properly, with the human kept in.
Lost your permit? The Comptroller's page explains you can request a duplicate through eSystems: log in, choose the account, open the sales and use tax menu under account self-service and select the duplicate permit option, then confirm the address and location. Keep your contact details current at the same time, because filing notices and approval letters go to the address on file.
Permits, resale certificates and franchise tax
A sales tax permit isn't the same as a resale certificate. The permit lets you collect tax from customers; a resale certificate lets you buy stock for resale without paying tax. My resale certificate guide explains how the two work together. The Texas franchise tax is a separate yearly filing for most entities.
My verdict
If you sell goods or a taxable service in Texas, get the permit before your first sale. It's an online form with numbers you already have, and it arrives within about two weeks. The two things worth checking early are whether your service is on the taxable list and whether part of the charge is exempt, as with data processing.
