W-8BEN Form Explained: Who Fills It In, Each Part and How Long It Lasts

Form W-8BEN is the IRS form a non-US individual gives a US payer to confirm they're a foreign person and, where a tax treaty applies, to claim a reduced rate of withholding. You give it to the payer or platform that asks for it, never to the IRS, and it usually stays valid until the end of the third calendar year after you sign it.

If you're a freelancer, creator or affiliate outside the US and a US client, platform or ad network asks for tax information, this is almost certainly the form. It's the foreign person's version of the W-9.

Who should fill in a W-8BEN

The IRS instructions say you must give Form W-8BEN to the withholding agent or payer if you're a nonresident alien who is the beneficial owner of an amount subject to withholding, or if you're documenting yourself as a nonresident alien with a foreign financial institution. The IRS also says to submit it when requested, whether or not you're claiming a reduced rate or exemption.

When to use a different form

If you are...Use instead
A US citizen or other US person, even living abroadForm W-9
A foreign company or other foreign entityForm W-8BEN-E
Claiming exemption on pay for personal services performed in the USForm 8233 or Form W-4
Receiving income effectively connected with a US trade or businessForm W-8ECI

That second row catches lots of small business owners. If you invoice through your own limited company, the company is the payee, so it's a W-8BEN-E, not a W-8BEN.

What happens if you don't send it

The IRS instructions are blunt: if you don't provide the form, the withholding agent may have to withhold at the foreign-person rate of three tenths of the payment, or at the backup withholding rate. Providing it, with a valid treaty claim where one applies, is how you get that reduced or removed.

The W-8BEN, part by part

Part or lineWhat goes thereThe catch
Part I, line 3Your permanent residence addressThe address in the country where you claim tax residence, not an address used only for mailing
Line 4Mailing addressOnly if it's different from line 3
Line 5US TIN (SSN or ITIN)Needed for certain treaty claims, unless you give a foreign TIN on line 6a
Line 6aForeign tax ID numberGenerally required for account holders receiving US-source income reported on Form 1042-S
Line 6bFTIN not legally required boxTick it if your country doesn't require you to have one
Part II, lines 9 and 10Tax treaty claimLine 10 is only for treaty conditions not covered by line 9, and needs the treaty article
Part IIICertification, signature and dateThe IRS accepts electronic signatures on withholding certificates under its regulations

For most freelancers, the important line is 6a. The instructions let you give the foreign TIN issued by your country of tax residence to claim treaty benefits instead of a US number on line 5. So a UK freelancer can generally give their UK tax reference here for a treaty claim, rather than applying for an ITIN first.

How long a W-8BEN lasts

Here's the date rule people forget. The IRS says a W-8BEN generally stays in effect from the date you sign it until the last day of the third calendar year after that, unless a change in circumstances makes it wrong. The IRS's own example: a form signed on 30 September 2015 stays valid through 31 December 2018.

If something on it becomes incorrect, you must tell the payer within 30 days and give them a new form. The IRS specifically names moving to a US address as a change in circumstances. If any income you've covered with a W-8BEN becomes effectively connected with a US trade or business, the instructions say the W-8BEN is no longer valid for that income and you must file a W-8ECI.

How to fill it in, step by step

  1. Check you're an individual and not a US person. If either answer's no, stop and use the right form.
  2. Enter your name, country of citizenship and permanent residence address.
  3. Add your foreign TIN on line 6a, or tick 6b if your country doesn't require one.
  4. Complete Part II only if you're claiming treaty benefits, naming your country of residence.
  5. Sign and date Part III.
  6. Send it to the payer or platform that asked. Don't send it to the IRS.

I've written country-specific walkthroughs for the W-8BEN for India and the W-8BEN for the Philippines, which cover the treaty lines for those countries. If you earn from Google ads, my guide to AdSense payments in Canada shows how this form fits into getting paid.

My verdict

Fill it in the day a US payer asks, because without it you can lose three tenths of every payment. Use your own country's tax number on line 6a, claim the treaty only if you're sure it applies, and put a reminder in your diary for the end of the third year after you sign. And if you invoice through a company, don't sign a W-8BEN at all: send a W-8BEN-E.

Frequently asked questions

What is a W-8BEN form?

It's the IRS form a foreign individual gives a US withholding agent or payer to confirm foreign status and, where eligible, claim a reduced rate of withholding under a tax treaty.

Do I send my W-8BEN to the IRS?

No. The IRS instructions say don't send Form W-8BEN to the IRS. Give it to the payer or withholding agent that asked for it.

How long is a W-8BEN valid?

Generally from the date it's signed until the last day of the third calendar year after that, unless a change in circumstances makes it incorrect.

What happens if I don't submit a W-8BEN?

The withholding agent may have to withhold at the foreign-person rate of three tenths of the payment, or at the backup withholding rate.

Can I sign a W-8BEN electronically?

Yes. The IRS instructions include guidance on electronic signatures on withholding certificates, so many platforms collect the form online.

Should a company fill in a W-8BEN?

No. Foreign entities use Form W-8BEN-E instead.

Do I need a US tax number for a W-8BEN?

Not always. For many treaty claims you can provide the foreign tax identification number issued by your country of tax residence on line 6a instead.
